In the past three decades, the evolution of feminist critiques of and approaches to international law have expanded the field. Issues that are often linked to women's rights have become increasingly visible and the scholarly literature on women and gender has flourished. With increased globalization and migration, family law, which was historically seen as a domestic legal field, has changed. Consequently, the advent of “international family law” has resulted in the emergence of TWAIL critiques. This chapter introduces and explores some of the methodologies and frameworks that scholars have developed in their critical approaches to international and comparative family law. These methods overlap with and borrow from TWAIL even if their authors might not identify their work as part of that critical approach. The chapter also suggests more work needs to be done to firmly establish what might be called “Third World Approaches to International Family Law”.
