This book started with an inquiry – whether judicial opinions written from feminist perspectives could have affected the development of the foundational legal subject of property law. We were inspired by how the original volume of the Feminist Judgments Series, Feminist Judgments: Rewritten Opinions of the United States Supreme Court, demonstrated that feminist reasoning could have changed the development of key areas of the law, including constitutional law doctrines, such as equal protection and due process, and the interpretation of certain federal statutory laws, such as Title VII and Title IX.1 We recognized the need to demonstrate how feminist analysis could similarly have affected the path of property law.
